These Terms of Service govern your use of albuquerquerecycling.net, operated by Albuquerque Computer & Electronics Recycling Co. (“ACER,” “we,” “us,” or “our”). By using this website, you agree to these terms. If you do not agree, please discontinue use.
1. Website information, fees, and service requests
Our website provides information about electronics recycling, data destruction, asset management, and related services.
ACER is a fee-based recycler. Hard-drive data destruction is included in our recycling fees. Applicable charges depend on the equipment and services involved and will be confirmed at intake or through your service arrangement.
Submitting a contact form or requesting a pickup, quote, or consultation does not by itself confirm an appointment, establish a price, or create a service agreement.
Published acceptance lists, prices, hours, and service descriptions may change. Please confirm relevant details before transporting equipment. ACER may decline items at intake because they are excluded, unsafe, damaged in a way that prevents acceptance, or materially different from what was described. Website updates do not change previously agreed service terms.
2. Equipment acceptance and residential drop-offs
You must own the equipment you submit or have authority to authorize its recycling and any associated data destruction. Disclose known hazards or special handling needs before delivery or pickup.
For walk-in and residential drop-offs, acceptance occurs when ACER staff agrees to receive the equipment for recycling and confirms any applicable fees. Leaving equipment unattended does not constitute acceptance.
Unless ACER agrees otherwise in writing before acceptance, equipment accepted for recycling is surrendered to ACER for processing, including applicable data destruction, reuse, recovery, or recycling. Ownership transfers to ACER upon acceptance, and accepted equipment is not returnable.
If a separate written service agreement applies, that agreement controls any conflicting provisions concerning the equipment or services.
3. Data-bearing equipment and documentation
Hard-drive data destruction is included in ACER’s recycling fees. Before submitting equipment, back up any information you need to retain. Data destruction is irreversible, and you should not expect to recover information after processing.
Discuss any special handling, destruction methods, inventory tracking, documentation, or regulatory requirements with ACER before acceptance. ACER will confirm the applicable service scope and any additional arrangements required.
If you need a Certificate of Data Destruction or other device-specific documentation, bring the equipment directly to ACER and request documentation at intake. Device-specific documentation is available only when ACER can associate the equipment with your intake record.
Do not send passwords, confidential records, or sensitive device contents through the website contact form.
Nothing in these terms reduces ACER’s responsibilities under an applicable service agreement or limits rights that cannot lawfully be waived.
4. Acceptable use
You agree not to:
- Use the website for unlawful, fraudulent, or deceptive purposes.
- Submit information you lack authority to provide.
- Attempt unauthorized access to the website or connected systems.
- Introduce malicious software or interfere with website operation.
- Use contact forms to send spam, threats, or abusive content.
ACER may restrict access when reasonably necessary to address misuse or protect the website and its users.
5. Website content
Website text, graphics, logos, and other materials belong to ACER or their respective owners and are protected by applicable intellectual-property laws.
You may view, download, or print materials for personal use or internal evaluation of our services, provided you retain ownership notices. This permission does not authorize commercial republication, resale, or misleading use of ACER’s name or branding.
6. Partner drop-off locations and third-party resources
Some independently operated collection locations accept electronics that are subsequently transferred to ACER for processing. Each location sets its own acceptance requirements, fees, hours, and collection procedures. Confirm those details directly with the location before visiting.
For equipment submitted through these locations, ACER’s responsibility for handling and processing begins when ACER receives the equipment at its Hawkins St. facility. Before that receipt, collection and custody are handled by the location and its transportation arrangements.
Equipment delivered through a partner location may not be traceable to an individual customer. If you require device-specific data-destruction documentation, bring the equipment directly to ACER and arrange documentation at intake.
Our website also links to third-party resources. ACER does not control those websites or their content.
7. Privacy and communications
Our Privacy Policy & SMS Terms explains how we handle website inquiries, telephone-service records, and caller-requested informational text messages. That page contains the terms governing our SMS program.
Calling ACER, providing a telephone number, or submitting a website form does not by itself constitute consent to receive text messages.
8. Website availability and limitations
The website is provided on an “as available” basis. Although we aim to provide reliable information and access, we do not guarantee uninterrupted operation or that every page will be free from errors.
To the extent permitted by law, ACER is not responsible for indirect or consequential losses arising solely from website unavailability or unauthorized website use.
This section concerns the website only. It does not disclaim obligations for equipment entrusted to ACER, override a service agreement, excuse fraud or willful misconduct, or limit liability or consumer rights that cannot lawfully be limited.
9. Governing law
These terms are governed by New Mexico law, except where applicable law requires otherwise. Nothing in these terms limits mandatory consumer protections available to you.
10. Changes to these terms
We may update these terms by posting a revised version with a new effective date. Changes apply prospectively and do not retroactively alter an existing service agreement or expand your consent to receive messages.
